No representation, perused the complaint. According to the Complainant, complainant has invested Rs.5,000/- on 26.07.2000 with Opposite party and maturity date is 26.07.2006. Complaint is filed on 19.10.2009 legal notice was issued on 16th 2009. After 2 1/2 years demand is made from maturity date. Though complainant has stated that complainant has visited the OP office on several occation from 14.08.2006 till 10.01.20089 what is the reply of OP is not all mentioned. No letter of complainant and reply of OP during this 2 1/2 years is not forthcoming. Hence, cause of action stated from 26.07.2006 and when there is no denial of claim two years to extend the period of limitation. The Complainant has not filed application under section 24 of the C.P.Act to condone the delay. Hence, the complaint is not filed within 2 years from the date of maturity and hence the complaint is barred by limitation. So the Complainant is not admitted and so we proceed to pass the following order. Complaint is not admitted and dismissed as barred by limitation.
