O R D E R

 

 

          Complainant Jitender has filed the present complaint for seeking relief for himself and for his father Shri Randhir Singh against the respondent alleging therein that on 16.2.2011 he has purchased two solar system on loan from the respondent worth Rs.58000/- and there was provision for subsidy to the tune of Rs.6300/-.  The total subsidy amount comes to Rs.12600/-  But till date, despite repeated requests, the subsidy amount of Rs.12600/- has not been paid to the complainant and that amounts to a grave deficiency in service on the part of the respondent.

 

2.        In reply, the respondent has submitted that the complainant has took the loan from the respondent for solar system.  The scheme of subsidy was intended by Nabard and the respondent has also sought permission from the Nabard to give subsidy to the complainant.  The amount of subsidy was to be paid by Nabard.  The complainant has not suffered any mental agony or harassment at the hands of the respondent and thus, prayed for the dismissal of the present complaint.

 

3.        We have heard the arguments advanced by both the ld. Counsel for the  parties and we have also gone through the entire relevant material available on the case file carefully & minutely.

 

4.        Complainant has submitted that he has purchased two solar system for Rs.58000/- from the respondent i.e. one for himself and the other in the name of his father.  But the subsidy amount to the tune of Rs.6300/- each i.e. Rs.12600/- has not been paid to the complainant so far.

 

          The respondent has submitted that the complainant has took the loan from the respondent for solar system.  The scheme of subsidy was intended by Nabard and the respondent has also sought permission from the Nabard to give subsidy to the complainant.  The amount of subsidy was to be paid by Nabard.  The complainant has not suffered any mental agony or harassment at the hands of the respondent.

 

          We have perused the circular of the respondent and subsidy to the tune of Rs.6300/- was available from Nabard on the model Venus-2(70 watt)-Four lights.  It is also mentioned that the subsidy will be kept in subsidy reserve fund and will be adjusted at the time of closure of the details of disbursement of the loan under the scheme…………………………………………… The perusal of the document C2 and C4 shows that the account of loan was closed and nothing was due towards the complainant and his father.

          Further more the General Manager of Gurgaon Gramin Bank has written a letter dated 28.12.2015 Ex.R2 to the Assistant General Manager, Haryana Regional Office, Nabard, Sector 34A, Plot no.3, Chandigarh for the release of the subsidy amount.

 

          Since there is no dispute with regard to the fact that the complainant and his father have purchased two solar systems, definitely they are entitled to get the subsidy worth Rs.12600/- i.e. Rs.6300/- each.  Accordingly, we hereby direct the respondent to pursue the matter with the department i.e. NABARD and to make the payment of Rs.6300/- in the name of complainant and Rs.6300/- in the name of Shri Randhir Singh father of the complainant, within a  period of three months from the date of passing of this order, failing which, the above said amount shall fetch interest at the rate of 09% per annum from the date of passing of this order till its actual realization.  The present complaint, thus, stands allowed.

 

          Certified copy of this order be provided to both the parties free of costs.

File be consigned to the record-room.
