ORDER

Present complaint under Section 12 of the Consumer Protection Act, 1986 as amended upto date has been filed by the complainant R.S. Dhillon against opposite party i.e. Gurdeep Singh Bajwa son of Sh.Sardara Singh Prop. Bajwa Fibre Glass Company, Backside Officers Colony, Kamra Bag, Kapurthala seeking direction against it for refund of Rs.2000/- alongwith interest snf also for damages on account of deficiency in its service. 2, Gist of the complaint is that complainant constructed a new house about one and half year ago at Kapurthala and wanted to have affixed a transparent fibre sheet at the outer gate of his new residence for which he approached opposite party and selected one white transparent fibre sheet . Opposite party offered to get the same installed at the rate of Rs.40/- per sq.ft. with promise to prepare manufacture and affix the same within fifteen days and the said settlement was on 1/4/2007. He paid a sum of Rs.2000/- as advance against receipt issued by the opposite party. It is further alleged that opposite party failed to affix the said transparent fibre sheet as promised despite his repeated requests and also legal notice dated 3/1/08 nor opposite party returned the amount of Rs.2000/-as advance received by it and as such is guilty of deficiency in service. 3. Inspite of service opposite party failed to appear and as such was proceed exparte. 4. Complainant led eparte evidence by filing affidavit Ex.C1 and receipt Ex.C2 and notice Ex.C3 5. We have heard exparte arguments of learned counsel for complainant perused the documents on the record. Complainant has reiterated his allegations in the complaint vide affidavit Ex.C1 about payment of Rs.2000/- as advance to the opposite party for affixing of transparent fibre sheet at the outer gate of his new resident but opposite party failed to render service nor returned amount of Rs.2000/- as advance vide receipt ex.C2 duly proved by the complainant and receipt of registered notice Ex.C3. Apparently there is deficiency in service on the part of opposite party and as such we direct the opposite party to refund amount of Rs.2000/- with interest @ 12% p.a. from the date of receipt till realisation alongwith damages of Rs.1000/- for causing mental agony and physical harassment with Rs.500/- as cost of litigation payable within one month by the opposite party to the complainant from the receipt of copy of this order. Let certified copies of judgment rendered be supplied/despatched to the parties without any unnecessary delay and thereafter file file be consigned to record room.
