1.   Gupta Electronics & Electricals through its Proprietor/Partner/ Manager/Authorised Signatory, SCF No. 219, Near Bus Stand, Manimajra, UT Chandigarh.

2.   Mobile Care(Authorised service centre) through its Proprietor/Partner/ Manager/Authorised Signatory, SCF No. 62, First Floor, Swastik Vihar, MDC Panchkula.

3.   Samsung India Electronics Private Limited through its Director/Managing Director/Authorized representative, 20^th to 24^th Floor, Two Horizon Centre, Golf Course Road, Sector-43, DLF Ph.-V, Gurgaon, Haryana-122202.

Complaint under Section 35 of Consumer Protection Act, 2019

Present:        Complainant in person.

                     Ms. Jyoti Rani, Advocate, Counsel for OP No. 3.

 

          Today the case is fixed for appearance. Ld. Counsel for the OP No. 3 on the instructions of OP No. 3 by making a separate statement stated that OP No. 3 is ready to pay an amount of Rs. 47,990/-, which is the price of the product in question, as full and final settlement of the dispute, subject to the condition that the Complainant shall return the product with all accessories to the OP No. 3 and that the OP No. 3 shall refund the above stated amount within 30 days from the date of order passed by this Commission.

 

 

          On the other hand, the Complainant by making a separate statement stated that he has gone through the statement made by the Ld. Counsel for the OP No. 3 and agrees with the same, hence, he withdraws the present complaint.

          Heard. In view of the statement made by both the parties, the present Consumer Complaint is hereby dismissed as withdrawn. It is made clear that both the parties shall be bound by their respective separate statements.

                     A copy of this order be sent to the parties, free of costs and File be consigned to the record room, after due compliance.
