Today, Sh. Manpreet Singh opposite party No. 2 has again made statement that invoice value i.e. Rs. 6,500/- would be paid within 7 days after 26.12.2015 to the complainant. Sh. Simranjeet Singh complainant has also made statement that opposite party No. 2 has agreed to refund the invoice value of Rs. 6,500/- to him after 26.12.2015, therefore, as a good well gesture he did not claim compensation or other litigation charges and has prayed to disposed of the complaint accordingly.

Heard. The instant complaint has been filed by the complainant under Section 12 and 13 of the Consumer Protection Act leveling various allegations against opposite parties alleging deficiency in services on their part. The opposite parties No. 1 and 3 filed written version. The case was at the stage of filing a written version on behalf of opposite party No. 2 when both the parties entered in to amicable settlement. On 22.12.2015, Manpreet Singh has made statement that the Samsung Company was ready to refund the invoice value of the mobile set in question i.e. Rs. 6,500/- to the complainant after 26.12.2015 and he has received the instructions from the Samsung Company. Today also Manpreet Singh has made another statement that amount of Rs. 6,500/- would be paid to the complainant within 7 days after 26.12.2015. Sh. Raj Kumar opposite party No. 1 has also made statement on 22.12.2015 that Samsung Company has agreed to refund the invoice value of the mobile set in question i.e. Rs. 6,500/-. The complainant has also made statement on 22.12.2015 that he accepted the offer of refund of Rs. 6,500/- made by the opposite parties. However, he claimed compensation and other litigation compensation. But today, he has made statement that as a good well gesture, he did not claim any compensation or litigation charges from the opposite parties.

In view of these circumstances, the opposite parties No. 2 and 3 are directed to pay Rs. 6,500/- (Six thousand five hundred only) i.e. invoice value of the mobile set in question to the complainant within 7 days after 26.12.2015 failing which the complainant would be entitled to get interest at the rate of 9% per annum thereon after 3.1.2016. Consequently, the complainant is disposed of accordingly. The parties will remain bound by the statements made in this Forum. The copy of order be supplied to the parties as per rules. The file be consigned to record room.
