ORDER

Learned counsel for the parties submit that the parties have arrived at an amicable settlement. As per the terms of settlement it is agreed that the amount of Rs.25,000/- deposited by the petitioner/opposite party in the District Forum shall be released to the respondent/complainant in full and final settlement of his claim. Besides the above amount the petitioners shall deliver to the complainant certified copies of the subject title deeds with a certificate to the effect that the originals which were deposited by the complainant are not traceable. It is submitted that the revision petition be disposed of in terms of the above settlement.

2.       In view of the above statement made by learned counsel for the parties, we allow the revision petition and modify the order of the Foras below as under: “that the petitioners shall pay to the respondent a sum of Rs.20,000/- as compensation towards deficiency in service and Rs.5,000/- as cost of litigation and in lieu of the original title deeds the petitioner shall give to the respondent/complainant certified copies of the subject title deeds alongwith a certificate to the effect that the title deeds which were deposited by the complainant are not traceable. It is submitted that sum of Rs.25,000/- is already lying deposited with the District Forum pursuant to the interim order of this Commission. Said amount be released to the complainant against the amount awarded. The petitioner shall deliver certified copies of the subject title deeds and the certificate as directed within two months failing which the respondent/complainant shall be entitled to execute the order.”

3.       Revision petition is disposed of accordingly.
