The complainant purchased a water bottle on 20/03/2022 from Meesho online platform believing the assurance of Opposite party that the bottle is of best quality and retains heat for at least 24 hours. The Opposite Party offered it as best quality, and retains heat for 24 hours. While using the same, the complainant came to know that quality of the product was found very poor which can retain heat for only 6 hours. On the next day itself the complainant tried to return it but Opposite Party did not co-operate with it. Due to the negligence and unfair trade practice on the part of Opposite party the complainant suffered loss and mental agony for which complainant claims for a compensation of Rs. 1000/-.
Notice of Opposite Party delivered (tracked) name called absent set exparte.
The complainant filed proof affidavit in lieu of chief examination screen shots of payment is produced as Ext A1.
The issues raised in this case is
- Whether there is deficiency in service on the part of Opposite Party ?
- Whether complainant is entitled for relief?
- If so what is the relief?
For convenience issues 1 to 3 can be discussed together.
The complainant purchased a water bottle through online platform from Meesho for his father.But on use the quality of the product was very poor, it can retain heat only for 6 hours.The complainant produced Ext A1 screenshot of payment as Ext A1 proves the purchase of water bottle from Meesho. In the absence of contra evidence complainants case is true.The allegation of the complainant is that the quality of the product was very poor.Due to the misleading offer from the side of Opposite Party, the complainant suffered mental agony and loss.The Opposite Party is bound to compensate the loss and agony undergone by the complainant.The complainant claims compensation of Rs. 1000/- it was a genuine prayer.Hence we allowed it with cost.
Therefore complaint is allowed directing Opposite Party to pay compensation of Rs. 1000/- (Rupees One thousand only) with Rs. 2000/- (Rupees Two thousand only) as cost to the complainant.
