Heard Mr.D.Sahu, learned counsel, appearing for the complainant. Also heard Ms. S. Dey, learned counsel, appearing for the opposite party.

       Mr. Sahu has fairly submitted that the complainant Company has closed down about 4/5 years back and at present there is none to represent the said Company with whom he can communicate for obtaining necessary instruction. He has also fairly submitted that it will not be possible to adduce evidence in view of the above situation.

       In the facts and circumstances of the above position, we are of the opinion that it will be difficult to proceed with the case further. Accordingly, the same is declared to be dismissed of for non-prosecution.
