The present Revision Petition has been filed by the revisionist/complainant challenging the order dated 22.09.2022passed by the District Consumer Disputes Redressal Commission, SAS Nagar, Mohali, (in short “District Commission”) whereby the evidence of revisionist/complainant has been closed by order.
2. Heard.
3. Learned counsel for the revisionists states that the wife of the counsel for complainant has been suffering from serious ailments since the year 2021 and the counsel being the sole adult member in the family had to tend to his wife on several occasions. He further states that the absence of the revisionists before the District Commission is not intentional and is bona fide.
4. We have heard learned counsel for revisionists and gone through the record of the case. The plea taken by learned counsel for revisionists is quite plausible showing that non-appearance of the revisionist was a bona fide one and is not intentional. As such, this Revision Petition is allowed and the impugned order dated 22.09.2022 is set aside. The case is remanded back to District Commission, SAS Nagar, Mohali, and the parties are directed to appear before the District Commission on 15.06.2023 with the direction to revisionist to tender evidence on 15.06.2023.
5. Pending applications, if any, are disposed of.
6. Registry is directed to immediately send the certified copy of the order to the District Commission.
