1. The complainant in the said complaint admitted that OP2 was admitted in the complainant hospital for delivery of second child and she gave a birth to a female child , Which was of 1 Kg and the child was kept int ventilator and her treatment was made free of cost under the ayushman Bharat Health Protection mission. Under the Ayushman Bharat Health Protection Mission .Under the Ayushman portal ,the complainant on 28.2.2022 applied for extension of keeping the child in ventilator with the OP1. But the OP1, has declined the request of complainant and the intimation to this effect was also given to the Ops No . 2 & 3 and apprised the Ops No. 2 & 3 that their ayushman card has not work and due to this OPs No 2 & 3 have to bear the expenses of the hospital at their own. The OP No.2 was discharged on 3.3.2022 and the complainant issue first bill on 2.2.2022 worth Rs 55000/- second bill on 18.2.2022 of Rs. 80000/- , third bill on 3.3.2022 worth Rs . 30000/- and fourth bill on 3.3.2022 worth Rs 49000/- and the bills were obtained by the OP1. Out of the said four bills, first three bills stands approved by the OP1 but the fourth bill was not approved by the OPs No.1 & 5 . However, no payment of the above said bill have been made to the complainant . Now the complainant after depositing Rs.22,190/- (deposited as a fee at the time of admission by OP2 and OP3) has submitted that Rs. 1,91,810/- are still due against the OPs No.2 & 3. Complainant futher submitted that the OPs No.2 & 3 are very shrewd person and become dishonest and made a application the the Deputy Medical Commission , Rupnagar on 4.4.2022 (herein referred as DMC) . DMC called the complainant for 5.4.2022 and the complainant appeared before the DMC on the said date. Now the case is referred to the State Health Agency, Chandigarh and is no dated is fixed for hearing.

The bench is of the view that till the application is pending before the State Health Agency, Chandigarh regarding the dispute between the parties till then no order required to be passed in the present complaint by the commission. However, the state health agency ,Chandigarh ,is required to settle the matter as early as possible . It is further directed that if the OP No. 4 got any payment from the government concerning OP2 and the same be paid as per rules. The notice dated 17.8.2022 from OP4 to the complainant will remain stay till the date of hearing before the State Health Agency m Chandigarh , which was stayed on 02.09.2022 . Thereofre , the present complainant is disposed of accordingly with the liberty to the complainant to file afresh ,if he/she desires so. The file be indexed& consigned to the Record Room.
