Heard Adv. Babrekar for appellant.  He has informed us that against the award passed by the District Consumer Forum, Amravati in CC No.24/1998, this appeal is filed in the year 2000.  During the pendency of this appeal the respondent / original complainant had filed execution proceedings bearing No.17/2000, which was pending in the District Forum Amravati. On 23.08.2001 the respondent herein had filed a compromise pursis wherein he stated that he had compromised the matter and he had informed the Forum below that because of compromise, he had given up the amount of compensation awarded by the Forum and he did not want to pursue the execution further. He took permission to withdraw the said case.  In the said Pursis he also mentioned that his electric connection was restored and he had been permitted by MSEB to pay the arrears by installments. Accordingly he was permitted to withdraw the execution proceedings by the Forum vide its order dtd.31.12.2001.  In view of the circumstances the appeal filed by the appellant is now rendered infructuous.  Hence, we pass the following order:-

 

ORDER

1.      Appeal is rendered infructuous in view of the fact that the respondent has withdrawn the Execution proceedings; he had filed before the Forum, in view of compromise.

 

2.      Appeal is disposed of as withdrawn.

 

3.      Copies of the order be supplied to the parties free of cost.
