ORDER

PER MR.JUSTICE R.K. BATTA, PRESIDING MEMEBR The Petitioner has sent a letter that due to ill health and economic status he is not been able to appear and a Counsel should be provided to him under the Legal Aid Scheme. We have gone through the records. The grievance of the Complainant is that he was suffering from severe stomach pain for several years after undergoing operation for piles in the year 1990 in the Government ESI Hospital, Ayanavaram. However, since the pain did not subside, he enrolled himself in the health check up at the Government General Hospital after paying Rs.250/-. Thereafter the Complainant was advised for barium meal test to find out the real cause of pain. However, the Complainant opted for Master Health Check- up in the Government General Hospital. The grievance of the complainant is that barium meal test was not conducted on account of which his problem of pain could not be diagnosed. The District Forum after examining the entire material on record came to the conclusion that the Master Health Check up Scheme did not include barium meal test. It was held that the brochure furnished by the Complainant consists of taking of x-ray, ECG, untrasound, blood test, but did not include barium meal test. In view of this, the complaint was dismissed on the ground that the Master Health Check up, did not include barium meal test. The Complainant challenged the said order before the State Commission. The State Commission also after verifying the records as well as the brochure furnished by the Complainant came to the conclusion that barium meal test was not included in the Master Health Check-up and as such dismissed the appeal. Thus, there are concurrent findings of two fora below. The main grievance of the Complainant is that in spite of the fact that he has undergone Master Health Check-up, barium meal check up was not done. The two fora below have come to the conclusion that the Master Health Check-up did not include barium meal test though other tests which were provided therein had been conducted. In view of this, we do not find any merit in this revision. The revision is hereby dismissed with no order as to costs.
