Final Order / Judgement

Record is placed before the National Lok Adalat as per order dated 20.06.2024 for settlement of the matter.

Both the parties are present. Heard both the sides as to settlement of the matter. Considered. It appears from the judgment dated 23.02.2022 passed by this Commission in CC/56/2020 that there was direction to the OPs/Jdrs to handover physical possession of 500 sq. ft. and 200 sq. ft. carpet area  on the first floor and ground floor of the building fully described in the schedule of the complaint petition to the complainant along with direction to the OPs/Jdrs to supply copy of completion certification and possession certificate to the complainant and an amount of Rs.5,000/- as litigation cost and the complainant was also directed to pay Rs.3,75,000/- to the OP-2 builder in terms of Clause 10 of the Tripartite Agreement dated 02.04.2019 and the direction shall be complied with within a period of 8 weeks from the date of passing of the order.

A petition is filed by the Dhr stating that the matter has been settled by and between the parties and the Dhr has no grievance more against the Jdr with the prayer for disposal of the matter. Copy is shown to the Jdr.  No objection is raised.

In view of the above discussion, it appears to us that the matter has already been settled.

Hence, the CDF Unit-II, EA No. 27/2022 is settled and disposed of finally through the National Lok Adalat.

Let a copy of this order be supplied to both the parties free of cost with proper endorsement.
