Today is fixed for hearing of the M.A. application W/O if any in the meantime.

Both parties are found ready.

Op side filed W/O.

On close examination of the application filed by ops on the ground that this case is not maintainable as the disputes involved is related with “Factories Act” and “Industrial Disputes Act”. On the other hand the op side has adopted the plea of causing damage to the properties of complainant by the ops.

After going through the material of the case record as well as the case record of C.C. 108 of 2021 it appears that the said complaint case is ready for disposal as the W/V has been filed by the op. It also reflected that after filing of evidence on both sides this case is to be finally disposed of.

In view of this position it would be just and proper to decide the maintainability point after completion of the trial of C.C. case no. 108 of 2021.

So, it would be wise and prudent to hear this M.A. case along with the trial of the C.C. case no. 108 of 2021.

In the light of the observation made above this M.A. case is disposed of at this stage.
