             Shri Rohit Kumar Singh, learned counsel for the appellant.

             Heard on IA 1 for condonation of delay.

             The delay is of two months and 6 days.

              We find that the same has been satisfactorily explained.  Accordingly, the application is allowed and delay in filing the appeal is condoned.

             This appeal assails the order dated 22.08.2019 passed by the District Consumer Disputes Redressal Forum, Bhopal-I (for short the ‘Forum’) in complaint case no.217/2013, whereby the Forum has dismissed the complaint for non-appearance of the counsel for the complainant and the complainant, when the case was called.

              We have gone through the reasons stated in the memo of appeal.   On going through the said reasons it appears that the counsel for the appellant was suffering from kidney problem and as such she was out of station and could not inform the appellant / complainant for remaining present before the Forum.   As a consequence the complaint was dismissed for non-appearance by the counsel for the appellant /complainant as also the complainant.

                The reasons stated appear to be bonafied and as such we are of the view that the absence of the appellant / complainant and his counsel deserves to be condoned.

               We accordingly, set aside the impugned order and allow the appeal.  In the result, the matter is remanded to the Forum for deciding afresh in accordance with law.  The appellant is directed to appear before the Forum on 08.04.2020.
