         This complaint is filed against Google India Pvt Ltd and Axis Bank alleging deficiency in service on the part of Opposite Party, after failure of a google transaction, money debited from the account of the complainant is not credited back to his account so far. Usually in case of failed transaction money debited from account will be refunded within 5 to 7 days. But the transaction made by the complainant on 10.09.2019 for Rs. 3895/ is not yet credited back to his account. Complainant is a medical representative. Complainant registered a complaint before opposite party No.2 on 17.09.2019,But there was no response from Opposite Party No: 2. Due to the deficiency of service on the part of opposite parties complainant suffered severe financial stress and mental agony as the money he lost was saved to meet his travels expenses. Due to non refund in time, Complainant was unable to meet his travelling expenses. Hence the complaint for necessary redressal.

              Opposite party No.1 to 3 served notice, but not appeared before the commission. Name of the opposite party No.1 and 2 called, absent set exparte.

            Advocate Giriprasad appeared and filed version for opposite party No.3. The main contention in  version is as follows:-

            Opposite party No.3 admits the purchase of the complainant for                 Rs. 3895.02/- from opposite party No.3 and tried to make payment through Google pay facility.   But the same was not credited to their account at that time.  Thereafter complainant paid amount by swiping his debit card.  Opposite Party further states that on 27/09/2019 complainant approached them to know the status of his payment through google pay and they replied him that the amount was not credited to their account till then.  Opposite party No:3 communicated the fact that if any amount is credited they will transfer the same to his account at the earliest and he was satisfied also.  Opposite Party No:3 made communication with their head office in this regard and came to know that the amount debited from the account of the complainant is later credited through google pay to their head office account.  On confirmation of the same Opposite Party No:3 has taken steps to refund the same.  Opposite party No.3 further stated that they had refunded the received amount on 25.10.2019 to the account of the complainant. There is no negligence on the part of Opposite Party No: 3.This Hon’ble form may be pleased to exonerate Opposite Party No: 3 from party array.

            Even after giving sufficient time with direction to adduce evidence, the complainant did not turn up.  No affidavit filed, no documents marked. Hence the complaint is dismissed for default with no order as to cost.
