Order No.31, Dated: 11.11.2016
Today is fixed for showing cause by the complainants as to why the case shall not be dismissed for default. The complainant files hazira. But the cause has not been shown by the complainant. On scrutiny of the record it appears that by passing order No.30 dated 3.11.2016 this Forum has been pleased to observe that the complainants were given several opportunities to supply the correct address of the O.Ps. but the complainant failed to supply the correct address. Lastly, after amending the complaint new addresses of the O.Ps., supplied by the complainants, were inserted and the notices were issued for service upon the O.Ps. It further appears that the complainants themselves received those notices at their own risk to serve the same upon the O.Ps. But upto 3.11.2016 the complainants did not submit any document or evidence showing that the notices were sent for service upon the O.Ps. Today on repeated calls none appears from the side of the complainants and in compliance with Order No.30 dated 3.11.2016 the complainants have not shown cause as to why the case shall not be dismissed for default.
In the above premises, there is no alternative but to dismiss the case. Hence, it is
Ordered
that the C.C. No.19/2015 is dismissed for default without any cost.
Let the copies of this order be supplied to the parties free of cost.
