Complainant has filed the present complaint against the OP alleging deficiency in service and claiming a sum of Rs. 50,000/-(Fifty thousand) besides other reliefs.

                         Perusal of the record shows that present complaint was filed on 12-01-2021, but inspite of  opportunities given to him, he did not comply with the direction given to him.

                     In the present case admittedly complainant is residing at RZB-74, SITAPURI-2, NEAR RAMANAND PAAN BHANDAR, DABRI, NEW DELHI, whereas the OP office is situated at19th floor, Tower A, B and C, Epitome building no. 5, DLF phase II, Sector 24, Gurugram, Haryana which does not fall within the territorial jurisdiction of this Commission. Hence, neither the complainant nor the OP or the cause of action arose within the territorial jurisdiction of this District Commission. We are, therefore, of the view that this Commission does not have the jurisdiction to entertain the complaint for want of territorial jurisdiction in view of the judgement of Hon’ble Supreme Court titled as M/s Sonic Surgical v/s National Insurance Company Limited.

                The complaint is therefore directed to be returned to the complainant along with annexures against acknowledgement. A copy of complaint be retained for records. Complaint is disposed off accordingly in above terms. A copy of order be sent to the complainant free of cost by post. Order be sent to www.confonet.nic.in. File be consigned to record room, announced in open Commission on………..
