This is an appeal filed against the order dated 19.10.2016 passed in C.C.No.138/2016 on the file of I Additional District Consumer Disputes Redressal Forum, Bangalore.
Complainant alleged deficiency in service on the part of OPs in not arranging the rescheduled tickets on 16.07.2015 for his return journey from Delhi inspite of confirmation, lodged the present complaint. District Forum on enquiry allowed the complaint in part directing OP Nos. 1 and 2 to pay Rs.4,286/- to the complainant with interest at the rate of 12% p.a. and further directed to pay Rs.5,000/- towards compensation and Rs.2,000/- towards costs.
Being aggrieved by the said order OPs are in appeal.
Heard counsel for parties. Alleging inconvenience caused due to non-booking of the return ticket seeking enhancement of compensation awarded by District Forum appeal is filed. The stand of the respondent herein Indigo is not made as a party. Moreover, though complainant himself has sought for higher compensation nothing is placed on record to show that higher amount paid for purchase of return ticket. He himself has stated returned through train.
Although amount awarded by the District Forum appears to be just and proper, facts remain Indigo Airlines has not been made as a party, matter requires reconsideration. Hence, the appeal is disposed of and the impugned order is set aside. Matter is remanded to the District Forum for reconsideration.
Complainant to implead Indigo Airlines as necessary party and the District Forum to dispose of the matter within three months from the date of receipt of the order.
