On 7-12-2018 complainant had booked one Hotel room at Srilanka for his relative through GOIBIBO application in India and paid Rs. 1041/- (Rupees One thousand and forty one only) for that . The address of the hotel is The Castle , 140 Adiambalama Road, PIN-11500, Siduwa, Srilanka. On 8-12-2018, when complainant’s relative reached there but no such hotel was there in that locality. Moreover, the place
mentioned where the hotel situated is a remote area of Srilanka and there is no scope for this kind of hotel. Thereafter complainant’s relative hired a taxi from Airport for enquiring about this hotel and with the help of taxi driver, he had find out accommodation in another hotel for rent. Thereafter, he registered complaint in GOIBIBO helpline and they enquired about this, but didn’t take any action regarding this. Thereafter complainant had filed a petition before National Consumer Helpline and opposite party called the complainant and enquired about this, but they didn’t take any action. Thereafter the National Consumer Helpline directed the complainant to wait for 5 days and directed to file a complaint before Consumer disputes Redressal Forum. Due to the repeated request of the complainant, opposite party returned Rs. 1041/-(Rupees One thousand and forty one only) to complainant on 10-01-2019. But complainant’s relative suffered a lot due to the deficiency of service done by opposite party in a strange place like Srilanka . Hence this complaint.
Notice sent from this Forum through speed post to opposite party and notice served on them and they did not turn up . Hence opposite party was set exparte.
In order to substantiate the case of the complainant, he filed an affidavit in lieu of Chief examination and the documents he produced were marked as Ext. A1 to A3 Ext.A1 which is the copy of Hotel confirmation Voucher where check in and checkout dates were mentioned, Ext.A2 which is the copy of details of the Hotel ‘The Castle’, Ext.A3 which is the copy of the Transport and Tour invoice.
The allegations against opposite party is proved by the unchallenged evidence of complainant . Hence we allow this complaint holding that opposite party is deficient in service.
Therefore we direct the opposite party to pay Rs. 5,000/-(Rupees Five thousand only) to complainant for the mental agony and hardship suffered by him by the act of the opposite party and Rs. 5,000/-(Rupees Five thousand only) as compensation for the deficiency in service of opposite party and financial loss sustained by complainant and Rs. 2000/- (Rupees Two thousand only) as cost. The order shall be complied within one month from the date of receipt of copy of this order.
If the above said amount is not paid to the complainant within 30 days from the date of receipt of copy of this order, the opposite party is liable to pay the interest at the rate of 12% per annum on the said amount from the date of receipt of the copy of this order till realisation.
