ORDER

The complainant present. Both the Advocates for the parties are present. The learned Advocate for the complainant has taken replacement of refrigerator after paying extra amount of Rs.5,100/-. The complainant has produced tax invoice dated 30/01/2010 for Rs.17,900/-. The complainant had purchased Godrej refrigerator for Rs.12,800/- on 31/10/2008 and now he has exchanged that item with new one. Therefore, the matter has been settled between the parties. The prayer of the complainant is for exchange of refrigerator or for payment of amount. Since the complainant has taken the exchange by paying an extra amount and therefore there remains no issue to be settled. However, the learned Advocate for the complainant submitted that the complainant has spent time, energy and money in filing this complaint. Therefore, suitable cost may be awarded to meet out his expenses. The submission of the learned Advocate is quite fair, just and reasonable. Therefore, it cannot be just, fair and proper to directed the opposite parties to pay cost of Rs.1,000/- to the complainant. In the result, I proceed to pass the following: ORDER 2. The complaint is disposed off since the matter has been settled between the parties. However, the opposite party No.1 and 2 are jointly and severally directed to pay Rs.1,000/- towards cost of the present proceedings within 30 days from the date of this order. 3. The opposite parties are directed to send the amount of Rs.1,000/- to the complainant directly by way of DD/cheque with intimation to this Forum. 4. Send the copy of the order to both the parties free of costs. 5. Pronounced in the Open Forum on this 2ND DAY OF FEBRUARY 2010. Order accordingly, PRESIDENT We concur the above findings.
