Judgment
This complaint is filed by the Complainant u/S 12 of the Consumer Protection Act, 1986 alleging deficiency in service as well as unfair trade practice against the OPs.
Today is fixed for admission hearing of the complaint. But none is present on behalf of the Complainant. No step has been taken for admission hearing. It is seen by us that this complaint was filed on 13.09.2018. Thereafter date was fixed for admission hearing on 27.09.2018. On the said date prayer was made by the Complainant and after considering the prayer next date was given on 04.10.2018. Due to no quorum admission hearing could not be taken and next date was fixed on 26.10.2018. On the said date further prayer was made on behalf of the Complainant and in the interest of justice date was given on 01.11.2018. But this day also the Complainant remains absent without taking any step. Under this circumstances we have no option but to dismiss the complaint as since filing of this complaint till date more than 21 days have already been elapsed and the Complainant did not take any step for admission hearing. Such inaction of the Complainant proves that he has lost his interest to proceed with this complaint.
Hence it is ordered that the consumer complaint no-384/2018 is hereby dismissed for default without being admitted. There is no order as to cost.
Let plain copy of this order be given to the parties free of cost as per the CPR, 2005.
