This appeal is directed against the order dated 03/08/2013 passed by the District Consumer Disputes Redressal Forum, Thane holding that the complaint filed by the appellant did not disclose that the forum had jurisdiction to try the complaint.  We heard the learned counsel Ms.Vaishali Banod for the appellant.

The complaint was in respect of refusal to refund the sum of `50,675/- towards cancellation of air tickets booked by the appellant.  Appellant resides at Bhiwandi within the jurisdiction of Thane District Forum.  However, payment for the ticket was made at Mumbai and, therefore, opponent/Airline Company stated that no part of cause of action arose within the jurisdiction of Thane District Forum.  We see that there is nothing wrong in the conclusion drawn by the District Forum, Thane that no cause of action arose within the jurisdiction of Thane District Forum. Impugned order does not call for any interference.  Appeal is summarily dismissed with a liberty to file a fresh complaint before the appropriate forum.
