Madhu Sudan vs. GM Northern Railway.

 

Present:Complainant in person with Sh.Mam Chand Adv.

            Sh.Parmod Gupta, Adv. for OPs.

           

              The ld. counsel for the complainant along with complainant made a joint statement that due to some technical defect they wants to withdraw the present complaint with the liberty to file a fresh complaint and prayed for returning the original documents.

         Heard.  In view of the statement made by the ld. counsel for the complainant along with complainant, the present complaint stands dismissed as withdrawn with the liberty to file a fresh complaint if so advised.  It will be open to the complainant to file an application before the concerned Court/authority under section 14 of the limitation Act for excluding the period spent before this Forum for the purpose of computation of limitation in terms and observations made by the Hon’ble Apex Court in the case of “Laxmi Engineering Works vs. PSG Industrial Institute 1995(III) SCC P.583”.  File be consigned to record-room after due compliance.
