            The case of the complainant is that he had purchased a printer head by name as Canon S 200 for Rs.1350/- from the opposite party on 25.7.2007.  When the complainant had inserted the above printer head to his computer, it was not functioning properly.  So the complainant returned the printer head to the opposite party on 28.7.2007.  After a lapse of two days, opposite party was reluctant to return the material to the complainant and on 14.8.2007, opposite party returned the same stating that opposite party is not liable to rectify any defects occurred in the above said printer head.  Hence the complainant is seeking relief against the opposite party to return an amount of Rs.1350/- and to pay a compensation of Rs.5000/-.

 

            Opposite party filed version stating that it is purely a commercial dispute and hence opposite party is not liable to return the amount.  On 26.12.2008, complainant was present.  Opposite party called absent and set exparte. 

 

            Complainant filed affidavit and Exts. A1 to A4 were marked.  From the affidavit and Exts. A1 to A4, complainant’s case is proved. 

 

            In the result, petition is allowed and the opposite party is directed to return the amount of Rs.1350/- and also to pay a compensation of Rs.1000/- to the complainant.  No order as to cost.

 

            Pronounced in open Court this the 29th day of December 2008.
