The case of the complainant is that he applied for a Permanent Residency Visa for Canada via Global Visas(OP) in March 2010. After registration of complainant, OP forwarded his case to Cape Town branch, South Africa for grant of Visa. Complainant enquired about the documents to be submitted for visa processing but OP did not answer queries of complainant. Complainant asked OP to transfer his case to Delhi branch and after five months, his case was transferred to Delhi branch.
It is further stated that complainant faced lot of problems while collecting his supporting documents for Canadian visa and tried to contact Ms. Pooja Sakhuja(Client Services Manager of OP) and other officials of OP but none of them helped him. After more than two months, complainant gathered all the documents and uploaded them on website of OP and sent hard copies through courier to Ms Pooja Sakhuja, to which she responded that she would take four to five days to review his case and will get back to him but after waiting and chasing for five days by phone, complainant did not get any response from OP.
It is further stated that after three months of submitting the documents, Ms Pooja Sakhuja called him and said that all his documents are perfect and she is going to send those documents by courier for his signatures which complainant was to send it back to Ms. Pooja Sakhuja alonwith the demand draft for embassy fee. Complainant waited for almost a week but did not receive any courier from OP. Complainant called her to inquire about the courier but she did not respond. After another one week complainant got a call from Ms Pooja Sakhuja saying that she cannot process his case because MBA degree of the complainant has been provided by his college not by his university. Complainant came to know that OP did not process it because by that time, the applications have been already reached at Canada office. When complainant asked Ms. Pooja Sakhuja to connect him to her branch manager, she said they all have gone on leave. After 15 days complainant got a mail from OP insisting him to go for other programs available with them.
It is further stated that complainant has paid Rs.65,000/- and extra Rs.20,000/- spent for IELTS exams, documents, notarization etc. Till date no one from OP has called complainant regarding his visa. OP has adopted deceptive means of trading and have not delivered the services to complainant as per the contract between the complainant and OP. It is prayed that OP be directed to pay Rs.85,000/- with interest to complainant and also to pay Rs.50,000/- for compensation.
Nobody appeared for OP despite service. OP proceeded exparte on 19.02.2013.
We have heard Ld. Counsel for complainant and carefully gone through the records.
Complainant has placed on record copy of documents pertaining to correspondence with OP regarding his registration for visa and account details showing payment received by OP amounting to Rs.65,077/-.
It is proved from the unrebutted testimony of the complainant that there has been deficiency in service on the part of OP.
OP is directed to refund a sum of Rs.85,000/- alongwith interest @ 9% p.a. from the date of filing of the complaint. OP is further directed to pay Rs.5,000/- as compensation and Rs.5,000 /- towards litigation expenses.
Let the order be complied with within one month of the receipt thereof. The complaint stands disposed of accordingly.
Copy of order be sent to the parties, free of cost, and thereafter file be consigned to record room.
