By G. Yadunadhan, President: The case of the complainant is that he entrusted a land phone viz., CDMA Tata Indicom bearing No.9249109584 for repair work to the opposite party. Opposite party failed to return the instrument to the complainant after getting repaired. Hence the complainant is seeking relief against the opposite party to pay a compensation along with the cost of instrument. After serving notice, opposite party called absent and set exparte. Complainant was examined as PW1 and affidavit filed. Ext. A1 was marked on the side of the complainant. From the affidavit and Ext. A1, complainant’s case is proved. In the result petition is allowed and the opposite party is directed to repay an amount of Rs.1500/- towards the actual value of the phone and also to pay a compensation of Rs.1000/- to the complainant.
