ORDER

Petitioner/complainant was allotted a MIG flat by the respondent. Complainant deposited Rs.15,020/- as registration amount on 22.10.1990, then she paid Rs.1,35,000/- in instalments.  Last instalment was paid in December 1993.  OP then demanded some more amount from the complainant under various other heads which was also paid on 10.1.1994. The possession of the flat was delivered within two years i.e. on 25.1.1995.  Alleging certain deficiencies, petitioner filed complaint before the District Forum.

 

District Forum allowed the complaint and directed the respondent to pay interest at the rate of 18% from 1.7.1993 to 25.1.1995 on the amount deposited up to 30.6.1993.  Rs.2,000/- were awarded by way of compensation and costs.  

 

          Petitioner as well as the respondent filed the appeals before the State Commission.  Appeal filed by the petitioner was dismissed.  The appeal filed by the respondent was partly allowed and the State Commission reduced the rate of interest from 18% to 6%.

 

          Petitioner/complainant, being aggrieved, has filed the present Revision Petition seeking enhancement of the interest.  In this case, petitioner had paid the last instalment in December 1993.  The possession of the flat was handed over to her within 14 months.

 

Keeping in view the facts and circumstances, we are of the view that the interest awarded by the State Commission is adequate.  No ground for further enhancement of the interest is made out.  Dismissed.
