FINAL ORDER

The instant Execution Application has been filed by the D.hr for realization of Rs.18, 000/- from the OP/J.dr. No.2.

The OP /J.dr. No.1 is the General Manager, B.S.N.L

In the final order passed ex parte in CC/55/2007 dt. 29.04.2008 there was no direction or any award against the OP /J.dr. No.1.

In this case, warrant of arrest was issued against the J.dr. No.2 for realization of the awarded aforesaid amount and from the execution report it appears that the company of the J.dr. No.2 was wound up and the said warrant of arrest could not be executed and for that this Forum passed order on 30.12.14 for taking steps by the D.hr. Subsequently, no steps were taken by the D.hr. Sufficient opportunity has already been given to the D.hr. for taking steps.

Considering the above facts and circumstances of the case and the matter being for realization of Rs.18, 000/- only from the J.dr. No.2 whose company has already been wound up , we have no other alternative but to dismiss the Execution Application for non-prosecution.

Hence,

Ordered

that the Execution Application No. 29/2008 be and the same is hereby dismissed for non-prosecution. There will be no order as to cost.

Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
