Order by Smt.SEENA.H, PRESIDENT.

Complainant is a retired employee of opposite party bank. As per the pension plan the opposite party bank has to deposit their  part of the contribution to the Pension Board at various intervals. The grievance of the complainant is that since opposite party failed to deposit the said amount, complainant could not avail pensionery benefit, arrears etc., Hence the complaint.

Opposite party filed version contending inter alia that complainant is not a consumer of opposite party and there is no consumer  dispute between the complainant  and opposite party. Further any dispute between the                      Co-operative Society and its Members are dealt under Section 69 of the          Co-operative Societies Act.

Preliminary  issue regarding maintainability raised. Forum vide order in I.A.379/2013 dated 05/02/2013 found complaint is not maintainable before the Forum.

Hence, without going into the merits of the case, we dismiss the complaint. Complainant directed to approach appropriate authority for relief.

Pronounced in the open court on this the 18th  day of  February  2014.
