ORDER NO. 5 DT. 2.5.11

Revisionist in person and the OP through Mr. S.Nayak along with Mr. Alok Mukhopadhyay, Ld. Advocates, are present. 

Having heard the Revisional Petitioner in person and considering the impugned order dt. 11.6.10 passed by Calcutta District Consumer Disputes Redressal Forum, Unit-I, Kolkata, in Case No. 189 of 2006, along with the facts and circumstances of this case we dispose of the Revisional Application by directing payment of cost of Rs. 1,000/- (Rupees one thousand only) by the OP to the complainant for not disclosing on 5.4.10 that they will  lead further evidence in the complaint case and for filing such further evidence on the next date fixed for hearing of the same.  However, since such further evidence on affidavit has already been filed the complainant will file questionnaire by 6.6.11.  Having regard to the nature of the case the Forum is directed to dispose of the same as expeditiously as possible.  The cost as above shall be paid by the OP to the complainant on the next date fixed, i.e. 6.6.11.
