ADV. RAVI SUSHA, MEMBER. The contents of the complaint can be summarized as follows: The complainant is a customer of BSNL Mobile phone. His connection was disconnected on 24.10.2007 due to the non payment of Bill amount. He has paid lbill amount on 15.11.2008 . But the connection is not updated till now. Hence there is deficiency in service on the part of opp.party and filed complaint for getting relief. Opp.party filed version contending as follows: The consumer was given telephone bill dt. 2.10.2007 for Rs.568/- The due date of payment of the bill was fixed on 22.10.2007. Since the payment was not made on or before due date the outgoing call facility to the phone was disconnected on 25.10.2007. Incoming call facility to the phone was retained till 29.10.2007 and the customer had not paid the bill till 29.10.2007 the incoming call facility was also disconnected on 29.10.2007. The bill dated 2.11.12007 for Rs.406/- was issued to him in the month of November 2007 for the usage upto 29.10.2007. The complainant paid and amount of Rs.550/- on 15.11.2007 against bill dated 2.11.2007. Out of that Rs.406/- was updated in the system against bill dated 2.11.1008 since that bill was amounting to Rs.406/- only and Rs.144/- was updated in the system against bill dated 2.10.2007 which was outstanding on 16.11.2007. The balance of Rs.424/- against bill dated 2.10.2007 was again remained unpaid the reconnection of the mobile phone was not effected on 16.11.2007. Later an amount of Rs.469/- was paid by the customer on 19.11.07 and the payment was updated in the system on 21.11.2007 and immediately the phone was reconnected on 21.11.2007. There is no deficiency in service on the part of the opp.party. Hence the opp.party prays to dismiss the complaint. Points that would arise for consideration are: 1. Whether there is deficiency in service on the part of the opp.party. 2. Relief and costs. For the complainant PW.1 is examined. Ext.P1 and P2 are marked. For the opp.party DW.1 is examined. Ext.D1 and D2 are marked. Points 1 and 2 Here the point to be decided is that whether there is any deficiency in service on the side of opp.party. According to the complainant he has paid the bill amount on 15.11.2007 . Opp.parties contention is that on 15.11.2007 the complainant paid only Rs.550/- against bill dated 2.11.2007. Out of that Rs.406/- was updated in the system against bill dated 2.11.2008 and Rs.144/- was updated in the system against bill dated 2.10.2007 which was outstanding since balance of Rs.424/- against bill dated 2.10.2007 was again remained unpaid the reconnection of the mobile phone was not effected. On 19.11.2007 the complainant paid Rs.469/- and on 21.11.2007 the phone connection was reconnected. During the evidence the complainant also admits that he had paid the entire dues only on 19.11.07. But according to complainant the opp.party ought to have reconnected the phone connection within 24 hours from the payment time. Opp.party denied that argument. According to the opp.party, there is no such practice or direction in existing Complainant failed to prove his contention complainant did not produce any documents or evidence to support his contention. Hence from the evidence before us we have an opinion that there is no deficiency in service on the part of the opp.party. In the result the complaint fails and it is dismissed without cost.
