Final Order / Judgement

                                                                Case No.  CC/93/2019

29

08.07.24

Today is fixed for filing evidence by the Complainant as another special chance but the Complainant is found absent on call.

The Complainant filed the instant case praying for a sum of Rs. 4,77,274/- to be paid by the OPs to the Complainant in terms of insurance policy.

The record shows that this Commission passed an order No. 6 dated 20.11.19 to the effect that the case do proceed ex-parte against the OPs. But since that time no evidence is adduced on behalf of the Complainant. Moreover, we find that the Complainant has not been taking steps for long period. Such being the position, we are of the opinion that the instant case has no merit and as such the Complainant is not willing to adduce evidence.

The instant case is liable to be dismissed.

             Hence, it is

                                                      Ordered

that the complaint Case No. CC/93/19 be and the same is dismissed on merit against the OPs.

Let plain copy of this order  be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand  /by post under proper acknowledgment  as per rules, for information and necessary action.
