HON’BLE JUSTICE SRI. K. SURENDRA MOHAN : PRESIDENT

This is a petition seeking transfer of C.C. No. 233/2023 of the District Consumer Disputes Redressal Commission (District Commission for short),  Alappuzha to the District Commission, Ernakulam.  The respondent entered appearance through counsel.  According to Adv. Saji Isaac who appears for the respondent they have no objection to the matter being transferred to District Commission, Ernakulam.  It is submitted that the complainant is from Thrissur and therefore Ernakulam is the most convenient District Commission for trial of the case.  We notice that this complaint was originally filed before the District Commission, Ernakulam and transferred to the District Commission, Alappuzha for the reason that one of the Members had a disability in hearing the matter.  Since the said Member has already demitted office it is submitted there is no difficulty in having the matter adjudicated before the District Commission, Ernakulam.  Since the respondent has no objection, taking into account the fact that the Member on whose behalf the matter was transferred to Alappuzha has already demitted office we are inclined to allow this transfer petition.  This petition is accordingly allowed.  C.C. No. 233/2023 pending before the District Commission, Alappuzha is transferred and posted to the District Commission, Ernakulam.  The District Commission, Ernakulam shall renumber the case and shall try and dispose of the same expeditiously.

This Transfer Application is allowed as above.
