This record is placed in view of the put up petition filed by the Complainant which is registered as MA 45/2022.

In the said petition, the Complainant have prayed for closure of the instant complaint and he does not want to proceed with this complaint further on the ground that he has already approached before the NCLT i.e. National Company Law Tribunal for seeking relief. According to the Complainant if this application is not allowed they will suffer irreparable loss and injury and prayer is made for allowing this application.

We have carefully perused the content of the application and in our opinion as the Complainant have already approached before the Ld. NCLT for redressal of their grievance and where the Complainant are not willing to proceed with this complaint, hence there is no bar to allow the MA 45/2022 filed by the Complainant.

Accordingly, the Consumer Complaint being no. CC 244/2020 is also dismissed due to non-prosecution.

On account of abovementioned order, the record need not be placed on 24.03.2022.

Let plain copy be given to the parties free of cost, as per CPR.
