Heard both sides.  There is marginal delay of 12 days in filing this appeal.  Delay is properly explained in the condonation of delay application, which is supported by affidavit.  As such, we are inclined to condone the delay, since there is no reply opposing condonation of delay application filed by the Non-Applicant/Respondent.  Hence, we pass the following order:

O  R  D  E  R

    (i)               Misc.Application No.80/2012 filed for condonation of delay is allowed.

  (ii)               Delay in filing appeal stands condoned with no cost.

(iii)               Matter stands adjourned for hearing on admission to 09/10/2012.
