We are happy to note that during the pendency of this Appeal and with the active and fruitful intervention of learned Counsel appearing for both the parties, the parties have arrived at an out of court amicable settlement. A Memo of Compromise, signed by the Complainant and the learned Counsel appearing for the Hospital has been placed on record. In terms of the compromise, the balance amount, standing to the credit of the present Appeal and stated to be invested in a Fixed Deposit with the Bank, in terms of the order dated 04.03.2014 passed -2- by this Commission, along with accrued interest thereon, if any, shall be released to the Complainant/Respondent herein forthwith by means of a Demand Draft drawn in favour of the Complainant. In light of the said gesture shown on behalf of the Hospital, the Respondent withdraws all the allegations of negligence on the part of the Hospital, if any. On receipt of the amount in terms of the compromise, the Complainant will not be left with any claim against the Hospital, subject matter of the Complaint, leading to the filing of the present Appeal. The statutory deposit made at the time of filing of the Appeal shall be refunded to the Hospital. The Appeal stands disposed of in the above terms with no order as to costs. |
