This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter thecommission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The 1st opposite party accepted the notice and not appear before this Commission and hence 1st opposite party was declared ex parte on 06/01/2021. Subsequently the case was adjourned for taking steps against the 2nd opposite party by the complainant. The complainant was continuously absent and not taken steps against the 2nd opposite party. Hence this Commission issued a notice to the complainant to appear before this Commission today to further proceed with this complaint. When the case came up for consideration today it is noticed that even after accepting the notice, the complainant has not appeared before this Commission to further proceed with this complaint. In view of the continuous absence of the complainant and not taking steps against the 2nd opposite party, we find that the complainant is not interested to further proceed with this complaint.
In the result the complaint is dismissed for default. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
