Member : Smt. Jhumki Saha. F I N A L O R D E R 1. The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the o.p. either to deliver 17,500 bricks or alternatively to refund the sum of Rs.78,750/- together with 18% interest and to pay compensation of Rs. 2 lakhs for unnecessary harassment and litigation costs as in spite of receiving the full amount did not deliver the bricks as agreed upon. Hence the case. 2. Sufficient opportunities were given to the o.p. to file the written version as he did not file the same, the matter was heard ex parte. 3. Two points arose for determination : i) Is there any deficiency in service on the part of the O.P. ? ii) Whether the complainant is entitled to get any relief as prayed for ? DECISION WITH REASONS : 4. Both the points are taken up together for consideration. From the enclosures and the money receipts it is palpable that the o.p. received Rs. 1,12,500/- from the complainant for delivering 25000 number of grade one bricks to the complainant. After delivering only 7500 number of grade one bricks the o.p. sat tight with further requests of the complainant. It is further palpable that 17500 number of grade one bricks are still due to be supplied. As the o.p. failed to supply the same we are of the view that this is a fit case where the prayer of the complainant shall be allowed. Both the points are accordingly disposed of. Hence, O R D E R E D That the C. C. Case No. 298 of 2013 ( HDF 298 of 2013 ) be and the same is allowed ex parte with costs against the o.p. The O.P. be directed to refund the sum of Rs. 78,500/- together with 10% interest p.a. from 17-03-2012 till full satisfaction within 30 days from the date of this order. The o.p. do further pay a sum of Rs. 10,000/- as compensation for causing mental pain and prolonged harassment to the complainant. The complainant is also entitled to a litigation cost of Rs.3,000/- from the o.p. The complainant is at liberty to put the decree into execution after expiry of the appeal period.
