Record is put up today for passing order on compromise petition, filed on 05.07.2024, heard in presence of both the sides on 31.07.2024.
On perusal of the compromise petition and the terms noted therein it appears that the OP shall register the Deed of Conveyance in respect of the flat No. 2A on 2nd floor measuring a super built up area of 1450 sq. ft. together with one demarcated open car parking space at premises no. 45A, Hazra Road, Kolkata-700019 as per revised building plan sanctioned by the KMC. It is also agreed between the parties that the OP shall handover the Completion Certificate, revised building plan to the complainant immediately and the complainant, on proposal as mentioned afore, agreed to bear all registration cost for registration of above mentioned flat and shall bear the income tax liabilities arises in further by the income tax authorities.
At the time of hearing it has been submitted for the OP that the OP is not in a position to supply CC to the complainant as it is the matter of way back of so many years.
Having heard the parties present and the compromise petition and the terms therein, the OP is directed to register the Deed of Conveyance in respect of the flat as mentioned in the compromise petition with one demarcated open car parking space in favour of the complainant and handover revised plan, Completion Certificate to the complainant within 60 days from the date of passing of this order.
Hence, it is
ORDERED
that instant Consumer Complaint be and the same is disposed of in terms of compromise petition which do form a part of this order.
If the OP transgress to comply the order within the period as mentioned afore the complainant shall be at liberty to put the matter into execution as per law.
