          In view of the statement of the counsel for the respondent/ complainant, which has been separately recorded, the appeal is allowed and the order of the District Forum is set aside with liberty to Lachhman Singh, through whom the complaint was filed as the next friend of Gaurav Kumar, complainant, to file a complaint in his own name before the District Forum and the District Forum, while computing the period of limitation, will exclude the period during which the complaint was being prosecuted before it and the period during which the opposite parties were prosecuting this appeal before this Commission.

2.      The sum of Rs.25,000/- deposited at the time of filing of the appeal along with interest which has accrued thereon, if any, shall be remitted by the registry to the appellants/opposite parties by way of  crossed cheque/demand draft after the expiry of 45 days of the sending of certified copy of the order to it.
