PER JUSTICE J.M. MALIK 1. Counsel for the parties heard. There was delay of 122 days in filing the First Appeal before the State Commission. However, since the State Commission awarded an amount of Rs. 2,00,000/- for a sum of Rs. 1872/- , therefore, we are inclined to ignore such delay. However, on merits the award of Rs. 2,00,000/- for a sum of Rs. 1872/- appears to be on the higher side. We have considered the prayer made by the respondent/complainant that they have suffered a lot due to this case. They claim that litigation charges as well as compensation for harassment and mental agony be also awarded. 2. We find force in the issue raised by the counsel for the respondent in a measure. We, therefore, reduce the compensation from Rs. 2,00,000/- to Rs. 1,00,000/- for which no objection has been raised. The said amount be paid within one month, failing which, it will carry interest @ 9%. NOC, if not already given, be given again in duplicate form within one month. 3. The revision petition stands disposed of. |
