Rachel Masih vs. Garg Motors.

 

Present:      Complainant in person.

                   Sh.Prince Srivastav, Adv. for opponent No.1.

                   Sh.JS Rana, Adv. for opponent No.2.

 

              On the intervention of the Commission, parties entered into amicable settlement. The opponent No.2 offered payment of Rs.32500/- (Thirty Two Thousand, Five Hundred only) to the complainant against invoice Ex.C.3, within the period of 30 days from today, which has been accepted by the complainant. Statement of complainant and counsel for opponent No.2 recorded separately.

                   Keeping in view the statements suffered by the complainant and counsel for opponent No.2 and without making any adverse comment on the act and conduct of any of the parties, the present complaint is, partly, accepted against the opponent No.2, holding it liable to make payment of Rs.32500/- (Rs.Thirty Two Thousand, Five Hundred) only against the invoice Ex.C.3, as full and final settlement of the matter. The opponent No.2 shall make payment of Rs.32500/- within the period of 30 days from today, in default of it, opponent No.2 shall be liable to pay simple interest @8% p.a. from the date of order till actual payment, subject to return of old machine, subject matter of invoice Ex.C.3 by the complainant to the opponent No.2, through opponent No.1 and on receipt of old machine from the complainant, the opponent No.1 shall issue acknowledgment, acknowledging the receipt of defective machine on particular date. The complaint qua opponent No.1 is dismissed, except receiving of old machine from the complainant against proper receipt as ordered above.

                   Certified copy of this order be supplied to the parties concerned, free of costs.

                   File be consigned to the records.
