As per Shri Justice Shantanu S. Kemkar :
This revision petition has been filed challenging the order dated 05.08.2019 passed by the District Consumer Disputes Redressal Forum, Gwalior (For short ‘Forum’) in C.C.No.86/2019 whereby the Forum has rejected the application filed by the petitioner/complainant for impleading New India Assurance Co. Ltd. as opposite party no.2 in the complaint.
2. Having gone through the impugned order we are of the view that the observations made by the Forum for rejecting the said application appears to be made without notice to the proposed opposite party New India Assurance Company Limited. In our view, whether New India Assurance Company Limited is a necessary party or not, ought to have been decided by the Forum after issuing notice to the said company and after considering their say.
3. In the result, we set-aside the impugned order and direct the Forum to issue notice to proposed opposite party New India Assurance Company Limited. The Forum shall be free either to decide the application at the preliminary stage or decide after reply as may filed by the proposed opposite party New India Assurance Company Limited to the complaint. All contentions to that effect are kept open.
4. The Forum shall proceed in the matter in accordance with law.
5. Parties to appear before the Forum on 09.01.2020.
6. With the aforesaid directions, the revision petition is disposed of.
