ORDER

Claim filed by the owner/respondent in whose name the insurance cover stood was repudiated on the ground that the owner - respondent - had sold the vehicle to Mrs. Kamala; that she did not have an insurable interest in the vehicle after the transfer.  The Registration Certificate and the insurance cover had not been

transferred in the name of the subsequent vendee.  In Revision Petition 2262 of 2007 titled National Insurance Co. Ltd. Vs. Jai Pal Singh & Ors. decided on 11.07.2011, following an earlier decision of this Commission in “Banowarilal Agrawalla vs. national Insurance Co. Ltd. & Anr. IV (2005) CPJ 110 (NC)”, we have taken a view that the insurance company cannot repudiate the claim filed by the original owner.  In view of the decision taken by this Commission in Jai Pal Singh’s case (supra), we find no merit in this Revision Petition.  Dismissed.
