         Adv. Dandige for the appellant is present. Respondent as well as his counsel are absent. The appellant has not complied the direction given on last date to deposit the statutory amount as per under section 15 of the C.P. Act. Therefore, the appellant is directed to comply with the order till 3.00 p.m. today; else, the appeal will be dismissed in default.

          The Matter was recalled at 3.25 p.m. but nobody appeared for the appellant. Its counsel Mr. Dandige also did not turn up. However, Adv. Mr. Choudhary for the respondent is present.

          Though Mr. Dandige, Advocate for the appellant submitted in morning session that he has intimated the official of the appellant for making payment of 50% statutory amount as provided under proviso of section 15 of the C.P. Act, but no intimation about the same is given by the official of the appellant. Therefore, the matter was kept back till 3.00 p.m. with a hope that any official of the appellant would appear and comply with the statutory provision u/s 15 of the Act but in vein. Hence, the appeal is dismissed in default.

           No order as to cost.
