         Adv. Mr. Mahakalkar present for applicant.  There is a Delay condonation application bearing No.MA/10/63 filed by the applicant.  Notice of this application was sent to the non-applicant.  Non-applicant received the notice and he engaged Adv.Uke alongwith three other advocates on his behalf, but none of the advocates are present today.

         Today, we are inclined to decide this delay condonation application. There is a delay of 32 days in filing the appeal bearing No.A/10/49. The reason for the delay in filing the appeal mentioned in para 3 of the said application, is that both the applicants were ill during the relevant time. In support of this reason applicants have filed medical certificates on record.  We are satisfied with the averment made by the applicants in para 3 of the said application.  Hence, we condone the delay of 32 days subject to cost of Rs.500/- to be deposited in Legal Aid Fund account of this Commission.  Hence, the following order:-

ORDER

1.         Delay condonation application bearing No.MA/10/63 is allowed. 

2.         The delay of 32 days in filing the appeal subject to cost of Rs.500/- to be deposited in Legal Aid Fund account of this Commission.

 3.        Copy of this order be supplied to the parties free of cost.
