Final Order / Judgement

MR. PRAVAT KUMAR PADHI, PRESIDENT:-

          This C.C.Case No. 11/2022 has been filed U/s-35 of C.P.Act, 2019 seeking compensation of Rs. 1,20,000/- to be recovered from Ops for deficiency in service & unfair trade practice.

            Brief fact of the case is that, Ration Card bearing No. 17012211062 was granted in favour of Complainant. In the year 2015 and cancelled on 15.01.2017. Petitioner has two unmarried son and one daughter who are staying with her husband jointly in one house at Chhotanathpur. Po- Siteleswar, Nial, Aul, Kendrapara. Previously one Antodaya Arna Yojana (AAY) card bearing No. 17012211403 was issued in the name of the family member of the Petitioner. After enquiry of Sarapanch of Nial Gram Panchayat has submitted a written statement that if one AAY ration card was issued in a family, then no separte additional ration card could not be issued to the same family. After detection of the said irregularities, the Block Authority mighty had cancelled the ration card of the Petitioner in the year 2017.

            Both parties are absent continuously since dt. 16.12.2022 on 10 occasions. We have gone through the records and found that the claim related to non distribution of PDS to Complainant which she is availing in another.

            For getting the PDS no consideration is being paid and it is a benevolent scheme of Govt. as such Complainant cannot be treated as a consumer as defined U/S-2(7) of C.P.Act, 2019.

            With the aforesaid observation and direction that, the C.C.Case No. 11/2022 is accordingly disposed off. No order as to cost.  

                              Issue extract of the order to the parties for compliance.   

           Pronounced in the open Commission, on this the 1st  day of November,2023.
