  1.   Pleadings of the complainant in brief

The complainant purchased a APE Goods Vehicle with Regn No. KL/09/AE/0016 from the opposite party on 17/01/2022. After 10 months, the chasis of the vehicle got damaged and vehicle was given to the opposite for repair. Even after 4 months, the opposite party has not returned the vehicle duly repairing the same. When the complainant filed a complaint before the Mannarkkad Police, they advised him to approach this Commission. Hence the complaint.

  2.   Notice was issued to the opposite party. But they did not enter appearance or file version. Hence opposite party was set ex-parte.

  3.   The complainant was absent continuously for further proceedings. Hence  the case was taken for orders based on merits.

  4.    As the complainant has been absent continuously for the proceedings, it is presumed that he is not interested in proceeding with the case. Complainant has failed to prove his case by adducing evidence.

  5.    Resultantly the complaint is dismissed.

                   Pronounced in open court on this the 22nd  day of December, 2023.
