Learned Counsel for the Appellant is present and filed a memo enclosing the copy of e-mail.

 

It appears from the records that  on dt.16-01-2023, Appellant was directed to file an affidavit indicating whether notice was given by the financier to the Complainant before repossession of the vehicle and whether presale notice was issued to complainant before sale of vehicle and the copy of agreement.  Appeal was posted to 08-02-2023, thereafter twice time was granted to the Appellant for the same.

 

To-day learned Counsel for the Appellant filed a memo enclosing copy of e-mail dt. 24-02-2023 showing the Appellant has sent the mail asking the appellant to supply the documents as per the direction of this Commission vide order dt.16-01-2023 but the appellant has failed to provide the documents. The Appellant  could not comply the order dt.16-01-2023.

 

In view of such, Appeal stands dismissed for non compliance of order dt. 16-01-2023 by the Appellant.
